DNASTAR is committed to providing you with excellent service. As part of our commitment, we recognize your right to privacy, and have developed this Privacy Statement to inform you about our privacy practices.

Information We Gather from You

Personal Information

We do not collect any personal information from a visitor to our site unless that visitor explicitly and intentionally provides it. If you are simply browsing our site, we do not gather any personal information about you. We use links throughout our site to provide you with the opportunity to ask questions, request information and materials, request demonstration software, or provide comments and suggestions. The information provided, such as your name and telephone number, will be used to help us satisfy your request, as described below.

Statistical Information About Your Visit

When you visit our site, our computers may automatically collect statistics about your visit. This information does not identify you personally, but rather about a visit to our site. We may monitor statistics such as how many people visit our site, the user's IP address, which pages people visit on our site, from which domains our visitors reach our site, and which browsers people use. We use these statistics about your visit for aggregation purposes only. These statistics are used to help us improve the performance of our website.

From time-to-time we may request information from customers via surveys. Participation in these surveys is completely voluntary and the user therefore has a choice whether or not to disclose this information. Survey information will be used for purposes of monitoring or improving the use of, and satisfaction with this website, and improving our customer service and product offerings.

Use of Cookies

We only use "cookies" as described in this section. A "cookie" is a piece of information that our website sends to your browser, which then stores this information on your system. Use of cookies is essential for certain parts of our website. Without enabling cookies, some sections of www.dnastar.com may not function properly. Our website uses cookies to "remember" your log-in information in order to help you navigate the website as seamlessly as possible. The cookie will be removed when you log-out or after 24 hours. You should be aware that cookies contain no more information than you volunteer, and they are not able to "invade" your hard drive and return to the sender with personal or other information from your computer.

How We Use the Information We Gather

Responding to Requests

We generally respond to any questions, requests for product information, and other inquiries that we receive. Our response may be in the form of an e-mail, telephone call, fax, or letter. We may retain this correspondence to improve our products, services, and website, and for other disclosed purposes.

We provide an "Opt-in" e-mail service for regular updates on our products and services. However, we may, from time-to-time, use additional contact information, such as e-mail addresses, mailing addresses and phone numbers, to share important product announcements. We retain contact information so that we can send individuals updates or other important information about our services and products.

Facilitating the support, renewal, and purchase of our products and services

We may use the information you submit to contact you to discuss the support, renewal, and purchase of our products and services. We may also provide the information you have submitted to us to a licensed distributor of DNASTAR products and services. Our distributors help us to provide our customers with support, assistance, and the provision of our products and services in certain markets. You may receive a communication directly from one of our representatives. Please be assured that if you are contacted by one or more of these entities for one of these purposes, they have agreed to use the information we supply only in accordance with a confidentiality agreement.

Privacy Statement for DNASTAR’s Usage Logging Feature

DNASTAR is also committed to understanding and anticipating user needs and continuously improving its software to meet those needs. Some of DNASTAR’s products may invite you to opt-in to DNASTAR’s Usage Logging Feature, which gathers information for that purpose. DNASTAR has developed this Privacy Statement for DNASTAR’s Usage Logging Feature.

Information We Gather from You

No personal information will be collected and participation status may be changed at any time. DNASTAR’s Usage Logging Feature is voluntary and users may generally opt out at any time.

By default, DNASTAR’s Usage Logging Feature is enabled in Lasergene version 11 and later. If a user decides to opt out on a Macintosh or Windows computer, they may do so from the Lasergene preferences within DNASTAR Navigator. Linux users may opt out by creating an empty file named reportusageoff and placing it in the folder /usr/lib/DNASTAR. Users of certain DNASTAR cloud-based products may not be able to opt out. For instructions on opting out of the usage logging feature in earlier versions of Lasergene or for more information, please contact DNASTAR support.

Customers who choose to participate agree to share information regarding computer hardware, operating systems, and DNASTAR product usage including, the name and version of the DNASTAR application being used, the date and time the application was launched and quit, basic system information (version, architecture, available RAM), the DNASTAR subscriber number or other unique device identifier, and type of DNASTAR license in use (e.g., standalone, free trial, or network).

How We Use the Information We Gather

Information will be recorded to a log file stored on a user’s machine when DNASTAR applications are launched and shut down. Once every day, the log will be transmitted to DNASTAR via an Internet connection.

If the computer is not connected to a network or the log is otherwise unable to be transmitted to DNASTAR, information will continue to be stored in the log file, and an attempt will be made to resend the information after the next seven-day interval.

Because no personally identifiable information is gathered as part of DNASTAR’s Usage Logging Feature, the information will not be meaningful to anyone other than specific DNASTAR software or product teams. Further, DNASTAR strives to protect information that is gathered. For example, we store the information gathered on computer systems with limited access located in controlled facilities in the United States or any other country in which DNASTAR or its affiliates, subsidiaries, or agents maintain facilities. However, despite DNASTAR’s efforts, no security controls are 100% effective and DNASTAR cannot ensure or warrant the security of gathered information.

DNASTAR uses the information to improve its software products and applications over time. DNASTAR may share gathered information with partners or other companies providing limited services on its behalf, but these partners and other companies are required to maintain the confidentiality of the information and are prohibited from using it for any other purpose.

DNASTAR may need to access or disclose the gathered information to comply with the laws or legal process and to exercise its legal rights or defend against legal claims. DNASTAR may also share gathered information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential safety threats, violations of DNASTAR’s terms of use, or as otherwise required by law.

You acknowledge that some goods licensed or sold on the DNASTAR Site are subject to the customs and export control laws and regulations of the United States of America and may also be subject to the customs and export laws and regulations of the country in which the products are manufactured and/or received and agree to comply with all applicable laws. By purchasing, downloading or using technology or software from the DNASTAR Site, you agree to abide by the applicable laws, rules and regulations and you agree, represent and warrant that no DNASTAR Materials will be accessed from, downloaded in, released in, carried to transferred to, transshipped through, exported to, or re-exported to any restricted territory (or national resident thereof), any person, entity or organization on the U.S. Treasury Department’s List of Specially Designated Nationals or the U.S. Department of Commerce’s Denied Persons List or Entity List, or otherwise in violation of law.

Order Acceptance and Billing

All sales are final. There are no refunds on any software licenses purchased from DNASTAR.

All billing information provided must be truthful and accurate. Providing any untruthful or inaccurate information constitutes a breach of this Agreement and may result in order cancellation. Prior to accepting an order we may also request additional information from you. We reserve the right to refuse or cancel an order for any reason including limitations on quantities available for purchase, inaccuracies, or errors in product or pricing information, or problems identified by our credit and fraud avoidance department. We will contact you if all or any portion of your order is canceled or if additional information is required to accept your order. DNASTAR may request a pre-authorization for some orders placed online with a credit or debit card. This pre-authorization will not be billed to you; however, your card issuer may hold this amount for a short period. Your card issuer determines the length of time the pre-authorization is held. We do this to ensure that the card details are still valid and that you have sufficient funds to complete the transaction.

To protect your privacy, we do not store your credit card information in our system after a transaction has been processed.

By confirming your purchase at the end of the checkout process, you agree to accept and pay for the item(s).

DNASTAR reserves the right to limit the quantity of items purchased per person, per organization or per order for any reason. These restrictions may apply to orders placed by the same account, the same credit card, and also to orders that use the same billing and/or shipping address. We will notify the customer should such limits be applied. DNASTAR also reserves the right, at our sole discretion, to prohibit sales to dealers or resellers. For purposes of this Agreement, reselling shall be defined as purchasing or intending to purchase any product(s) from DNASTAR for the purpose of engaging in a commercial sale of that same product(s) with a third party.

You agree to defend, indemnify, and hold harmless DNASTAR and its affiliates from and against any and all claims, damages, costs, and expenses, including attorneys' fees, arising from or related to your use of the DNASTAR Site or any breach by you of this Agreement.

We reserve the right to make changes to our site, policies, Service Terms, and these Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

You may not incorporate any portion of the DNASTAR Software into your own programs or compile any portion of it in combination with your own programs, transfer it for use with another service, or sell, rent, lease, lend, loan, distribute or sub-license the DNASTAR Software or otherwise assign any rights to the DNASTAR Software in whole or in part. 3. Perpetual Licenses. In the normal course of business, DNASTAR frequently grants the user of our software a perpetual license for the use of such software. A perpetual license is defined as the use of the license for the software version purchased, for an unlimited period of time. A perpetual license does not permit users to place DNASTAR's software on more computers than were licensed for use in the initial purchase. DNASTAR is not under any obligation to provide users of the software with support or additional copies of the original version of software purchased for backup, upgrades to new computers, or for any other purpose. In addition, DNASTAR is under no obligation to update its software for new computer operating systems, hardware configurations or for any other reason after initial purchase of the license by the customer. Users may continue to use a particular software version after DNASTAR support has been discontinued as long as the use of such software is not in conflict with any more recent license agreement agreed upon by the customer and only on the number of computers originally covered in the purchase agreement with DNASTAR or one of its distributors or agents.
  4. Use of Third Party Services. When you use the DNASTAR Software, you may also be using the services of one or more third parties, such as a wireless carrier or a mobile platform provider. Your use of these third party services may be subject to the separate policies, terms of use, and fees of these third parties.

  6. Updates. In order to keep the DNASTAR Software up-to-date, we may offer automatic or manual updates at any time and without notice to you.
  7. Government End Users. If you are a U.S. Government end user, we are licensing the DNASTAR Software to you as a "Commercial Item" as that term is defined in the U.S. Code of Federal Regulations (see 48 C.F.R. § 2.101), and the rights we grant you to the DNASTAR Software are the same as the rights we grant to all others under these Conditions of Use.
  8. Commerical Services. If you use DNASTAR software as part of a service you or your organization provides to others for a fee, you are required to have a "Commercial Services" license provided by DNASTAR.

This Agreement is effective unless and until terminated by either you or DNASTAR. You may terminate this Agreement at any time, provided that you discontinue any further use of the DNASTAR Site. DNASTAR also may terminate this Agreement at any time and may do so immediately without notice, and accordingly deny you access to the DNASTAR Site, if in DNASTAR’s sole discretion you fail to comply with any term or provision of this Agreement. Upon any termination of this Agreement by either you or DNASTAR, you must promptly destroy all materials downloaded or otherwise obtained from the DNASTAR Site, as well as all copies of such materials, whether made under this Agreement or otherwise.

This Agreement represents the complete agreement between the parties and supersedes all prior agreements and representations between them. Headings used in this Agreement are for reference purposes only and in no way define or limit the scope of the section. If any provision of this Agreement is held to be unenforceable for any reason, such provision shall be reformed only to the extent necessary to make it enforceable and the other terms of this Agreement shall remain in full force and effect. The failure of DNASTAR to act with respect to a breach of this Agreement by you or others does not constitute a waiver and shall not limit DNASTAR's rights with respect to such breach or any subsequent breaches.
